These Terms of Service ("Terms") govern your use of the website kastallis.com and the services provided by Kastallis Productions Inc. ("Kastallis", "we"). By accessing our site or engaging our services, you accept these Terms.

1. Services Offered

Kastallis is a video and content production agency offering, among other things:

• Brand films and corporate video
• Event coverage and live streaming
• Social and digital content
• 3D effects, motion design, and projection mapping
• Photo production
• Strategic consulting and creative direction

Each project is subject to a separate written agreement (quote, scope of work, or contract) detailing deliverables, timelines, and pricing.

2. Quotes and Pricing

Quotes are valid for 30 days from the date issued. Prices are in Canadian dollars (CAD), excluding taxes unless stated otherwise. Project pricing depends on scope, complexity, and final deliverables, established during preliminary discussions.

3. Payment Terms

Unless otherwise agreed in the project contract:

• Deposit: 50% of total at project kickoff
• Balance: due upon delivery of final files
• Late payments: subject to interest of 2% per month
• Accepted methods: bank transfer, e-transfer, credit card, cheque

4. Intellectual Property

• Pre-existing materials: all proprietary tools, methods, templates, and know-how remain the property of Kastallis.
• Final deliverables: ownership of the final approved video and content is transferred to the client upon full payment.
• Raw footage and project files: remain the property of Kastallis unless purchased separately.
• Portfolio rights: Kastallis reserves the right to feature the work in its portfolio, showreels, and marketing materials, unless a confidentiality agreement provides otherwise.
• Third-party content: the client is responsible for clearing rights to any material they provide (music, footage, logos, talent).

5. Cancellation Policy

• Cancellation by the client before kickoff: deposit is non-refundable.
• Cancellation during production: fees incurred up to the cancellation date are billed in full.
• Cancellation by Kastallis: in exceptional circumstances; pro-rata refund.

6. Deliverables and Revisions

Deliverables are described in the project contract. Each project includes two (2) rounds of revisions unless agreed otherwise. Additional revisions are billed at our current hourly rate.

7. Client Obligations

• Provide accurate briefs, materials, and feedback in a timely manner
• Obtain all necessary permissions (locations, talent, music, logos)
• Respect agreed timelines for feedback and approvals
• Pay invoices according to agreed terms

8. Confidentiality

Both parties undertake to keep confidential any non-public information exchanged during the project, except where disclosure is required by law.

9. Limitation of Liability

To the maximum extent permitted by law, Kastallis's total liability for any claim related to the services is limited to the total amount paid by the client for the relevant project. Kastallis is not liable for indirect, consequential, or special damages.

10. Force Majeure

Neither party is liable for delays or failures due to events beyond their reasonable control (illness, equipment failure, weather, government restrictions, etc.).

11. Modifications to These Terms

We may modify these Terms at any time. Changes apply to new projects from the date of update. The latest version is always available at kastallis.com/terms-of-service.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Quebec and the applicable federal laws of Canada. Any dispute will be submitted to the exclusive jurisdiction of the courts of the district of Montréal.
